Domain Registration Agreement

This Domain Registration Agreement ("Agreement") governs the registration and management of domain names through Hostwover.

This Agreement is entered into between:

• Hostwover ("Hostwover", "we", "us", or "our"); and
• the individual or organization requesting, purchasing, controlling, or using a domain-registration Service ("Customer", "you", "your", "Registrant", or "Registered Name Holder", as applicable).

By submitting a domain-registration request, accepting this Agreement, or using a domain-registration Service provided through Hostwover, you agree to be bound by this Agreement.

This Agreement forms part of Hostwover's Terms of Service.

Your domain registration may also be governed by:

• Hostwover Terms of Service.
• Registrar Information.
• Domain Transfer Agreement.
• Domain Renewal & Expiration Agreement.
• Domain Expiration & Recovery Policy.
• Domain Dispute Policy.
• Privacy Policy.
• Acceptable Use Policy.
• Abuse Handling Policy.
• Refund Policy.
• Trademark & Copyright Policy.
• applicable registry policies.
• applicable Sponsoring Registrar requirements.
• applicable ICANN policies.
• applicable dispute-resolution policies; and
• applicable law.

You agree to comply with all requirements that validly apply to your domain registration.

For this Agreement:

Domain Name

A domain name requested, registered, transferred, renewed, restored, or managed through Hostwover.

Registrant

The person or organization identified as the holder of the domain registration according to the applicable registration records.

Registered Name Holder

The person or organization recognized as holding the applicable domain registration under the relevant registration records and policies.

Sponsoring Registrar

The registrar responsible for sponsoring the particular domain registration within the applicable registry.

Registry Operator

The entity responsible for operating the registry for the applicable top-level domain.

TLD

A top-level domain such as .com, .net, .org, or another domain extension.

gTLD

A generic top-level domain subject to applicable ICANN requirements.

ccTLD

A country-code top-level domain governed primarily by its applicable registry and relevant rules.

Registration Data

Information collected or processed in connection with the registration and management of a domain.

Hostwover may provide functionality including:

• domain availability search.
• registration.
• renewal.
• transfer.
• restoration.
• contact management.
• registrant-information management.
• DNS management.
• nameserver management.
• DNSSEC where supported.
• domain locking.
• authorization-code management.
• automatic renewal.
• domain-security functionality.
• domain-related notifications; and
• customer support.

Available functionality may vary depending on:

• TLD.
• registry.
• domain status.
• applicable policy.
• technical capability; and
• Service configuration.

Domain registration operates through a distributed system involving multiple technical and administrative functions.

Depending on the domain extension, the registration may involve:

• Hostwover.
• the Sponsoring Registrar.
• the Registry Operator.
• ICANN, where applicable.
• DNS infrastructure.
• registration-data systems.
• escrow systems.
• dispute-resolution providers; and
• relevant authorities.

Certain actions requested through Hostwover therefore require processing or approval within external domain-registration systems.

When you submit a registration request, you authorize Hostwover to perform the actions reasonably necessary to attempt registration of the requested domain.

This may include transmitting:

• the requested domain name.
• registration period.
• registration contact information.
• technical information.
• nameserver information.
• payment confirmation.
• verification information; and
• other information required for the registration.

Submission of a request does not guarantee successful registration.

Domain availability information is provided based on information available at the time of the search.

A domain displayed as available is not guaranteed to remain available.

Availability may change between:

1. search.
2. adding the domain to an order.
3. checkout.
4. payment.
5. registration submission; and
6. final registration confirmation.

A third party may register the domain during this period.

Unless Hostwover expressly states otherwise, placing a domain:

• in a shopping cart.
• in checkout.
• in a quotation.
• in an unfinished order; or
• in another pre-registration state

does not reserve the domain.

The domain remains subject to registration by other parties until successful registration has been confirmed.

A registration is considered successfully completed only after the applicable registration system confirms the domain registration.

The following actions alone do not guarantee successful registration:

• availability confirmation.
• order creation.
• invoice creation.
• payment authorization.
• payment completion; or
• registration submission.

Your Hostwover Account or applicable notification will indicate registration status where functionality is available.

A registration may fail for reasons including:

• the domain becoming unavailable.
• registry rejection.
• invalid Registration Data.
• eligibility restrictions.
• reserved-name restrictions.
• premium-domain classification.
• verification failure.
• payment problems.
• technical errors.
• domain-policy restrictions.
• legal requirements; or
• another registration-system limitation.

If a paid registration cannot be completed, Hostwover will handle the affected charge according to the applicable Refund Policy, Terms of Service, and mandatory law.

You are solely responsible for verifying the domain name before completing the order.

You should carefully review:

• spelling.
• characters.
• extension.
• hyphens.
• numbers; and
• internationalized characters.

Once a domain has been successfully registered, it generally cannot simply be renamed to another domain.

A spelling mistake by the Customer does not automatically make a successfully completed registration refundable.

Mandatory consumer rights remain unaffected.

Domains are registered for finite registration periods.

Available registration terms depend on:

• the TLD.
• registry rules.
• domain status.
• applicable policies; and
• available Hostwover options.

Registration does not grant an indefinite right to the domain.

The registration must be renewed according to applicable requirements to remain active beyond its current term.

A domain registration provides the Registered Name Holder with contractual rights to use and control the domain for the applicable registration period, subject to:

• this Agreement.
• applicable registry requirements.
• Sponsoring Registrar requirements.
• applicable ICANN policies.
• dispute-resolution procedures.
• applicable law; and
• continued compliance with registration requirements.

Registration does not give the Registrant an unrestricted right to use the domain for unlawful purposes or in violation of third-party rights.

You must provide the Registration Data required for the relevant domain.

Depending on the TLD and applicable requirements, this may include:

• Registrant name.
• organization name.
• email address.
• telephone number.
• street address.
• city.
• postal code.
• state or region.
• country.
• administrative information.
• technical information.
• billing information; and
• other required details.

You represent that Registration Data you provide is:

• accurate.
• reliable.
• complete.
• current; and
• not intentionally misleading.

You must not knowingly provide:

• a false identity.
• a fabricated address.
• an invalid email address.
• unauthorized third-party information.
• false organization information; or
• deliberately misleading Registration Data.

You are responsible for keeping Registration Data current throughout the registration period.

For applicable domain registrations, changes to required contact information should be corrected or updated promptly and, where applicable policy requires, within the period specified by that policy.

For applicable gTLD requirements, this may include updating relevant contact information within seven (7) days after a change.

Hostwover may provide Account functionality allowing eligible Registration Data to be updated.

Certain changes may require verification.

You must respond to legitimate inquiries regarding the accuracy of your Registration Data.

Where applicable gTLD requirements apply, failure to respond for more than fifteen (15) days to an inquiry concerning the accuracy of required contact information may result in additional verification, suspension, cancellation, or another action permitted or required by applicable policy.

You are responsible for ensuring that the email address associated with your registration remains accessible.

Domain registrations may require verification.

Verification may occur:

• when a domain is registered.
• when Registration Data changes.
• when information appears inaccurate.
• following a security event.
• following an ownership dispute.
• following an abuse report.
• during account recovery.
• when legally required; or
• where applicable domain policies require it.

Verification may include:

• email confirmation.
• telephone confirmation.
• identity documentation.
• business documentation.
• ownership evidence.
• authorization documents; or
• another reasonable method.

If required verification is not completed within the applicable period, the domain may be:

• restricted.
• locked.
• suspended.
• placed on hold.
• prevented from resolving.
• prevented from being modified; or
• cancelled

where permitted or required by applicable policy.

Hostwover is not responsible for interruption caused by a Customer's failure to complete a legitimate mandatory verification requirement after appropriate notice.

If you register a domain on behalf of another individual or organization, you represent that:

• you are authorized to do so.
• you are authorized to provide the required Registration Data.
• the information is accurate.
• the actual Registrant has been informed of applicable obligations; and
• you will not falsely identify yourself as the Registrant without authority.

You may be responsible for ensuring that the actual Registrant complies with applicable registration terms.

Where you authorize another person to manage a domain, you remain responsible for ensuring that the person has appropriate authority.

Hostwover may rely on actions performed through authenticated Account access unless we reasonably know that such access is unauthorized.

Certain sensitive operations may require additional verification.

If a domain is registered for a company or organization, the person submitting the registration represents that they have authority to act for that organization.

Hostwover may request documentation establishing authority where:

• ownership is disputed.
• Account access is lost.
• a company representative changes.
• fraud is suspected; or
• another ownership-sensitive event occurs.

The Hostwover Account holder and the Registered Name Holder may not always be the same person.

Control of a Hostwover Account alone does not necessarily determine legal entitlement to a domain.

Likewise:

• payment for the domain.
• website administration.
• possession of hosting credentials.
• DNS access; or
• technical control

does not automatically override applicable domain-registration records.

Domain ownership and control disputes may therefore require additional evidence.

You authorize the processing of Registration Data reasonably necessary to:

• register the domain.
• maintain the registration.
• renew the registration.
• manage the registration.
• process transfers.
• verify information.
• protect domain security.
• handle disputes.
• comply with registry requirements.
• comply with applicable ICANN requirements.
• comply with law; and
• otherwise provide Domain Services.

Additional information is provided in Hostwover's Privacy Policy.

Registration Data may be provided to entities involved in the applicable domain-registration process where necessary.

Depending on the domain, this may include:

• the Sponsoring Registrar.
• Registry Operator.
• escrow systems.
• dispute-resolution providers.
• verification systems.
• competent authorities; or
• other authorized participants.

Disclosure will be subject to applicable policies and law.

Personal Registration Data is not necessarily publicly displayed in full.

For applicable gTLDs, Registration Data is processed according to the applicable ICANN Registration Data Policy and related requirements.

Depending on the domain and applicable requirements, Registration Data may be:

• published.
• redacted.
• restricted.
• withheld from public display.
• disclosed following an appropriate request; or
• otherwise processed according to applicable policy.

Non-public Registration Data may be disclosed where a valid basis exists under applicable law or policy.

Requests may arise from:

• courts.
• law-enforcement authorities.
• regulators.
• dispute-resolution providers.
• intellectual-property rights holders.
• cybersecurity investigators; or
• other authorized parties.

A request does not automatically guarantee disclosure.

Applicable requirements will determine whether disclosure is permitted or required.

Where domain privacy functionality is offered for an eligible domain, its availability depends on:

• TLD.
• registry requirements.
• Sponsoring Registrar requirements.
• applicable law.
• domain status; and
• technical availability.

Domain privacy does not allow you to provide false Registration Data.

Accurate underlying information may still be required.

Hostwover may offer security or protection functionality for eligible domains.

Depending on the Service, protection functionality may help reduce the risk of unauthorized:

• transfers.
• contact changes.
• nameserver changes.
• ownership changes; or
• other sensitive actions.

The precise functionality is determined by the applicable product description.

No protection feature can guarantee that every domain-related security incident will be prevented.

Certain domain names may be classified as Premium Domains.

Premium Domains may have:

• higher registration prices.
• higher renewal prices.
• higher transfer prices.
• higher restoration prices; or
• other special pricing conditions.

Premium classification may be determined by the applicable domain-registration system.

A domain may initially appear available at a standard price but later be identified as premium during registration processing.

In such circumstances, Hostwover may:

• request additional payment.
• request confirmation of the premium price.
• cancel the incomplete registration request; or
• provide another applicable option.

Hostwover will not knowingly complete a materially higher-priced premium registration without the required authorization.

A Premium Domain may also have premium renewal pricing.

You should not assume that a Premium Domain will renew at a standard TLD renewal price.

Current renewal pricing should be reviewed before renewal.

Certain domains may be:

• reserved.
• blocked.
• restricted.
• premium.
• protected.
• subject to eligibility requirements; or
• unavailable for normal registration.

A search result showing apparent availability does not override a registry or legal restriction.

Certain TLDs may require Registrants to satisfy conditions relating to:

• nationality.
• residence.
• local presence.
• organization status.
• profession.
• industry.
• trademark ownership.
• government status.
• geographic location; or
• another eligibility condition.

You are responsible for satisfying all applicable eligibility requirements.

Hostwover may require supporting documentation when necessary to complete or maintain an eligible domain registration.

Failure to provide required evidence may prevent registration or affect an existing registration.

Some domain extensions support Internationalized Domain Names ("IDNs").

IDNs may contain non-ASCII characters and may be represented technically using encoded forms.

You are responsible for checking the actual characters in the requested domain.

Hostwover is not responsible for confusion caused solely by visually similar characters selected by the Customer.

You agree to pay the price displayed for the applicable registration before completing the order, subject to:

• premium-domain confirmation.
• pricing errors.
• taxes.
• currency changes.
• applicable fees; and
• other disclosed conditions.

Domain registration prices may vary by:

• TLD.
• registration period.
• premium status.
• promotion.
• currency; and
• applicable taxes.

Promotional registration prices may apply only:

• to new registrations.
• to selected TLDs.
• for selected registration periods.
• during a limited promotion; or
• subject to other stated conditions.

A promotional registration price does not guarantee the same renewal price.

Applicable domain charges may be subject to:

• VAT.
• sales taxes.
• registry charges.
• government charges; or
• other mandatory fees.

Such charges will be handled in accordance with applicable law and the relevant order.

Domain registration requires successful payment unless Hostwover expressly provides another arrangement.

You represent that you are authorized to use the submitted payment method.

Fraudulent or unauthorized payment methods must not be used.

Successful payment does not guarantee successful registration.

A domain may become unavailable or registration may otherwise fail before the registration process is completed.

If registration cannot be completed, the applicable payment will be handled according to Hostwover's Refund Policy and applicable law.

Domain-registration transactions may become irreversible once completed.

Accordingly, successfully completed domain registrations are generally not refundable except:

• where expressly permitted under Hostwover's Refund Policy.
• where the registration system permits reversal.
• where Hostwover determines a refund is appropriate; or
• where required by applicable law.

This includes situations where the Customer:

• changes their mind.
• no longer needs the domain; or
• entered the wrong domain name

after successful registration, unless an applicable mandatory right provides otherwise.

After successful registration, the domain may require additional configuration before a website, email account, or other Service becomes accessible.

Registration alone does not automatically create:

• a website.
• hosting.
• email.
• SSL.
• DNS configuration; or
• another Service

unless expressly included.

You may be able to configure the nameservers used by your domain.

Incorrect nameserver settings can cause:

• website downtime.
• email disruption.
• verification failures.
• certificate problems; or
• other Service interruptions.

You are responsible for nameserver configuration that you control.

Where Hostwover provides DNS-management functionality, you are responsible for DNS records you create or modify.

Incorrect DNS records can affect:

• websites.
• email.
• APIs.
• authentication.
• domain verification.
• certificates.
• applications; and
• other Internet Services.

DNS changes may require time to propagate through distributed DNS infrastructure and caching systems.

Hostwover does not guarantee that every DNS resolver worldwide will reflect a change immediately.

DNSSEC may be available for certain domains.

Improper DNSSEC configuration may cause domain-resolution failure.

You should only enable or modify DNSSEC when you understand the applicable configuration or follow appropriate instructions.

A domain may support one or more locking mechanisms.

Locks may help protect against unauthorized:

• transfer.
• deletion.
• modification; or
• other domain actions.

Certain locks may also be applied because of:

• security concerns.
• disputes.
• verification.
• policy requirements.
• registry action; or
• legal requirements.

Some domain operations require an authorization credential such as:

• Auth Code.
• EPP Code.
• Transfer Code; or
• another equivalent credential.

You must keep authorization credentials confidential.

Disclosure of an authorization code to an unauthorized party may create a risk of unauthorized transfer.

Changes to Registrant information may be subject to:

• verification.
• confirmation.
• transfer restrictions.
• security review.
• applicable ICANN policies.
• registry requirements; or
• other domain-specific requirements.

A change to certain Registration Data may therefore not take effect immediately.

Transfers are governed by Hostwover's Domain Transfer Agreement and applicable domain policies.

A domain may be subject to transfer restrictions relating to:

• recent registration.
• recent transfer.
• Change of Registrant.
• domain lock.
• disputes.
• fraud.
• payment issues where applicable.
• legal orders; or
• other permitted circumstances.

A domain registration expires unless renewed.

Renewal terms are governed by:

• this Agreement.
• Domain Renewal & Expiration Agreement.
• Domain Expiration & Recovery Policy.
• applicable registry requirements; and
• applicable domain policies.

You are responsible for monitoring your domain's expiration date.

Where Auto-Renew is available and enabled, Hostwover may attempt to renew the domain using an authorized payment method.

You authorize the applicable renewal charge when Auto-Renew is enabled.

Auto-Renew is a convenience feature and does not guarantee successful renewal.

Auto-Renew may fail because of:

• insufficient funds.
• rejected payment.
• expired payment method.
• unavailable payment authorization.
• Account restriction.
• verification requirements.
• domain status.
• registry restriction.
• technical problems; or
• another processing failure.

You remain responsible for ensuring your domain is successfully renewed.

Hostwover may send notices about upcoming domain expiration or renewal using Account contact information.

For applicable gTLD registrations, additional renewal or expiration communications may be required under applicable domain policies.

You are responsible for maintaining an accessible and accurate email address.

Failure to read a renewal notice does not automatically extend the registration term.

If a domain is not renewed, it may expire.

Expiration can result in:

• website interruption.
• email interruption.
• DNS changes.
• domain parking.
• suspension of resolution.
• grace-period status.
• redemption.
• deletion; or
• registration by another party.

Exact lifecycle stages depend on the applicable TLD.

Some domain extensions may provide a post-expiration renewal grace period.

Grace periods:

• are not guaranteed for all TLDs.
• may differ between domains.
• may change.
• may be shortened or unavailable in certain circumstances.

You should not rely on a grace period instead of renewing before expiration.

Certain domains may enter a redemption or restoration period after expiration.

Restoration may require an additional recovery fee.

Recovery pricing can be significantly higher than normal renewal pricing.

Payment of a restoration fee does not guarantee successful restoration if the domain is no longer recoverable.

Once a domain has completed its applicable expiration and deletion lifecycle, it may be released for registration by another party.

Hostwover cannot guarantee recovery after the domain has been released.

If another person registers a legitimately released domain, Hostwover may have no ability to return it to the previous Registrant without an applicable legal or dispute-resolution basis.

You are responsible for the registration and use of your domain.

You must use the domain in accordance with:

• applicable law.
• this Agreement.
• Terms of Service.
• Acceptable Use Policy.
• registry policies.
• applicable domain policies; and
• third-party rights.

A domain must not be used to conduct or facilitate prohibited activity.

This may include:

• phishing.
• malware.
• credential theft.
• fraud.
• impersonation.
• malicious redirects.
• botnet activity.
• illegal spam.
• unlawful Content.
• intellectual-property infringement; or
• other activities prohibited under Hostwover's Acceptable Use Policy.

Hostwover may investigate credible reports that a domain is being used for prohibited activity.

Depending on circumstances, Hostwover may:

• request information.
• request remediation.
• restrict certain domain functionality.
• apply a security lock.
• suspend associated Services.
• preserve evidence.
• cooperate with applicable domain authorities; or
• take another action permitted by applicable agreements and law.

Additional procedures are described in the Abuse Handling Policy.

A domain may be suspended or placed on hold where permitted or required because of:

• inaccurate Registration Data.
• verification failure.
• fraud.
• security threats.
• abuse.
• legal requirements.
• court orders.
• domain disputes.
• registry requirements.
• applicable ICANN requirements.
• payment-related circumstances where permitted; or
• material violation of applicable terms.

Suspension may prevent the domain from resolving.

Hostwover may take immediate protective action where reasonably necessary to address an urgent threat involving:

• phishing.
• malware.
• compromised credentials.
• active cyberattacks.
• fraud.
• serious abuse.
• security compromise; or
• another material threat.

Where appropriate, Hostwover may contact the Registrant after taking emergency action.

Availability of a domain does not mean that registration or use of the domain is legally permitted.

You are responsible for determining whether your chosen domain may infringe:

• trademarks.
• trade names.
• copyrights.
• personality rights.
• geographic indications.
• business names; or
• other third-party rights.

Hostwover does not provide legal clearance merely because a domain appears available.

Domain registrations may be subject to dispute-resolution proceedings.

Depending on the domain, procedures may include:

• Uniform Domain Name Dispute Resolution Policy ("UDRP").
• Uniform Rapid Suspension System ("URS").
• ccTLD dispute procedures.
• registry-specific policies.
• trademark procedures.
• court proceedings; or
• other applicable dispute mechanisms.

You agree to be bound by applicable mandatory domain-dispute procedures.

Where the UDRP applies to a domain, the registration is subject to the policy and applicable procedural rules.

A UDRP proceeding may result in outcomes including:

• denial of the complaint.
• transfer of the domain; or
• cancellation of the domain.

Hostwover will implement a binding UDRP decision where required by applicable policy.

Certain domains may be subject to the Uniform Rapid Suspension System.

Where applicable, a valid URS determination may affect the operation of the domain according to the applicable procedure.

Hostwover may be required to implement a valid court order concerning:

• ownership.
• transfer.
• suspension.
• deletion.
• disclosure.
• preservation; or
• another domain-related action.

Hostwover will assess and process legal orders according to applicable law.

If multiple parties claim rights to a domain, Hostwover may require evidence such as:

• government identification.
• organization documents.
• authorization evidence.
• Account history.
• payment information.
• historical Registration Data.
• court orders; or
• dispute-resolution decisions.

Hostwover may restrict sensitive changes while a credible ownership dispute is being investigated.

Hostwover is not a court or trademark tribunal.

Where conflicting ownership claims cannot reasonably be resolved through Account or registration records, Hostwover may require the parties to obtain:

• a court decision.
• UDRP decision.
• applicable dispute-resolution decision; or
• another legally binding determination.

Registry Operators may take action affecting a domain according to applicable registry rules.

Actions may include:

• reservation.
• suspension.
• lock.
• deletion.
• correction.
• transfer.
• status changes; or
• technical changes.

Hostwover may be required to implement or reflect applicable registry actions.

For domain registrations subject to ICANN requirements, you agree to comply with applicable ICANN Consensus Policies and other mandatory requirements that apply to the registration.

Applicable policies may change during the registration term.

Hostwover may update Domain Services or procedures where necessary to implement applicable policy changes.

Registry, ICANN, technical, regulatory, or legal requirements may change after registration.

Such changes may affect:

• Registration Data.
• verification.
• privacy.
• renewal.
• transfers.
• eligibility.
• security.
• disputes.
• DNS.
• lifecycle rules; or
• other aspects of the registration.

You agree that mandatory changes may be applied to an existing registration where required.

A domain may be used with other Hostwover Services, including:

• Web Hosting.
• Professional Email.
• VPS.
• VDS.
• Google Workspace; or
• other Services.

However, the domain registration remains a distinct Service unless expressly bundled otherwise.

Cancelling one Service does not necessarily cancel the others.

Cancelling:

• hosting.
• Professional Email.
• VPS.
• VDS.
• Google Workspace; or
• another Service

does not automatically cancel or delete your domain registration.

Similarly, cancellation or transfer of a domain does not automatically cancel unrelated Services.

You authorize Hostwover to send necessary domain-related communications concerning:

• registration.
• verification.
• ownership.
• transfers.
• renewal.
• expiration.
• billing.
• security.
• abuse.
• suspension.
• disputes.
• changes to applicable policies; and
• other domain-management matters.

These messages are Service communications and are distinct from optional marketing.

You are responsible for maintaining current Account and domain contact information.

A notice sent to the current email address associated with the relevant Account or registration may be treated as properly sent where legally permitted.

You are responsible for protecting:

• Hostwover credentials.
• email credentials.
• MFA credentials.
• authorization codes.
• recovery methods.
• API credentials; and
• other authentication information.

You must notify Hostwover promptly if you suspect unauthorized domain access.

If Hostwover reasonably believes a domain or Account has been compromised, we may:

• temporarily restrict domain changes.
• require password reset.
• require identity verification.
• apply a lock.
• restrict transfer.
• review recent changes; or
• take another reasonable protective measure.

If you believe a domain has been transferred or modified without authorization, you must contact Hostwover as soon as possible.

Delays may reduce the availability of technical or policy-based recovery mechanisms.

Hostwover may require documentation establishing prior control and identity.

Domain registration does not guarantee uninterrupted:

• DNS resolution.
• registry operation.
• nameserver availability.
• Internet connectivity; or
• third-party DNS service.

Hostwover will seek to provide Domain Services according to applicable commitments but cannot guarantee continuous availability of systems outside its control.

Domain-management functionality may occasionally be unavailable because of:

• maintenance.
• security updates.
• registry maintenance.
• technical upgrades.
• network incidents; or
• emergency work.

Hostwover may perform emergency maintenance without advance notice where reasonably necessary.

You are responsible for:

• selecting the correct domain.
• maintaining accurate Registration Data.
• responding to verification requests.
• protecting your Account.
• maintaining access to your email.
• monitoring domain expiration.
• paying renewal fees.

• maintaining lawful domain use.
• maintaining DNS configuration.
• complying with domain policies; and
• reporting unauthorized activity promptly.

For domain registrations subject to applicable ICANN requirements, Registrants may have rights concerning access to information about:

• registration.
• management.
• transfers.
• renewal.
• restoration.
• pricing.
• applicable terms.
• dispute handling; and
• identification of the Sponsoring Registrar.

Nothing in this Agreement is intended to remove a mandatory Registrant right.

Do not send:

• your Hostwover password.
• private keys.
• complete payment-card information.
• CVV.
• API secrets.
• session tokens.
• MFA recovery codes; or
• unrelated identity information

through ordinary support communications.

Hostwover may provide a secure method where sensitive verification information is legitimately required.

To the maximum extent permitted by applicable law, you agree to indemnify Hostwover against third-party claims, damages, liabilities, and reasonable costs arising directly from:

• unlawful registration or use of your domain.
• infringement of third-party rights by your domain use.
• fraudulent Registration Data.
• unauthorized registration performed by you.
• Customer Content associated with the domain; or
• your material breach of this Agreement.

This obligation does not apply to the extent a claim results from Hostwover's own conduct for which Hostwover is legally responsible.

Nothing in this section limits mandatory consumer rights.

Where applicable registry requirements impose lawful obligations concerning claims arising from a domain registration, you agree to comply with such mandatory requirements to the extent they validly apply to your registration.

Nothing in this provision creates an obligation exceeding what is permitted under applicable law.

Hostwover's liability concerning Domain Services is subject to the limitation-of-liability provisions in the Hostwover Terms of Service.

To the maximum extent permitted by applicable law, Hostwover is not responsible for losses arising solely from:

• Customer spelling errors.
• inaccurate Registration Data provided by the Customer.
• Customer failure to renew.
• Customer failure to respond to verification.
• Customer disclosure of authorization codes.
• Customer Account compromise caused by Customer-controlled credentials.
• Customer DNS configuration.
• Customer infringement of third-party rights; or
• another Customer-controlled action.

Nothing in this section excludes liability that cannot legally be excluded.

Registration of a domain does not guarantee that:

• no third party will challenge it.
• no trademark claim will arise.
• no court proceeding will occur.
• no abuse complaint will be submitted; or
• the registration can never be suspended or transferred under applicable law or policy.

Domain search tools are intended to help identify possible registration availability.

Search results do not constitute:

• trademark clearance.
• legal advice.
• ownership confirmation.
• guaranteed registration.
• guaranteed pricing where premium status remains unconfirmed; or
• confirmation of eligibility.

You must not use Domain Services in violation of applicable law.

Hostwover may refuse, restrict, or terminate a domain-related action where providing that action would violate a binding legal requirement.

Domain registrations may be affected by:

• laws.
• regulations.
• sanctions.
• court orders.
• governmental requirements.
• national registry rules; or
• other legally binding restrictions.

Hostwover may take actions necessary to comply with such requirements.

Hostwover may update this Agreement to reflect:

• changes to Domain Services.
• registry policy changes.
• ICANN policy changes.
• changes to registration-data requirements.
• legal developments.
• security requirements.
• operational changes; or
• clarification of existing terms.

The latest published version will display an updated Last Updated date.

Where applicable law or contractual requirements require notice of a material change, Hostwover may provide notice through:

• email.
• Account notification.
• website notice; or
• another appropriate communication method.

Where explicit consent is legally required, Hostwover will seek that consent.

Updated mandatory domain policies may apply to existing registrations where required by:

• applicable law.
• ICANN policy.
• registry policy.
• Sponsoring Registrar requirements; or
• another binding domain requirement.

Hostwover cannot contractually prevent the application of such mandatory requirements.

If this Agreement conflicts with a mandatory requirement applicable to a domain, the mandatory requirement will control to the extent of the conflict.

Such requirements may arise from:

1. applicable law.
2. court or regulatory orders.
3. applicable ICANN policies.
4. registry requirements.
5. Sponsoring Registrar requirements; or
6. applicable dispute-resolution policies.

Subject to mandatory consumer and other legal protections that may apply, this Agreement is governed by the law specified in Hostwover's Terms of Service.

Where the Terms of Service specify the laws of the Arab Republic of Egypt, the same governing law applies to this Agreement unless mandatory domain requirements or applicable law require otherwise.

General disputes between you and Hostwover concerning this Agreement are handled according to:

• Hostwover Terms of Service; and
• Complaints & Dispute Resolution Policy.

Domain-specific ownership or trademark disputes may instead be subject to:

• UDRP.
• URS.
• applicable ccTLD dispute procedures.
• registry-specific dispute procedures.
• court proceedings; or
• another applicable mechanism.

If a provision of this Agreement is found invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.

The invalid provision will be interpreted or limited only to the extent necessary under applicable law.

Failure to immediately enforce a provision of this Agreement does not permanently waive the right to enforce that provision.

You may not transfer contractual control of a domain outside the applicable domain-transfer or ownership-change procedures.

Valid domain transfers and Registrant changes must follow the procedures applicable to the registration.

This Agreement, together with:

• the Terms of Service.
• applicable order information.
• Registrar Information.
• applicable domain policies.
• applicable Service terms; and
• documents incorporated by reference

forms the agreement governing the applicable domain-registration Service.

You may accept this Agreement electronically.

Hostwover may maintain records concerning:

• Agreement version.
• acceptance date.
• Account.
• order.
• IP information; and
• associated transaction information

where appropriate to document acceptance.

• providing accurate Registration Data.
• keeping that information current.
• protecting your Account.
• responding to required verification.

• renewing the domain on time; and
• complying with the requirements applicable to your registration.
