1. Introduction

This Professional Email Agreement ("Agreement") governs the purchase, provisioning, administration, access, use, renewal, suspension, cancellation, and termination of Professional Email Services provided through Hostwover.

This Agreement is entered into between:

  • Hostwover ("Hostwover", "we", "us", or "our"); and
  • the individual or organization purchasing, administering, accessing, or using the Professional Email Service ("Customer", "you", or "your").

By ordering, activating, renewing, configuring, administering, or using a Hostwover Professional Email Service, you agree to this Agreement.

This Agreement forms part of Hostwover's Terms of Service.

2. Related Agreements and Policies

Your use of Professional Email is also subject to applicable Hostwover legal documents, including:

  • Terms of Service.
  • Acceptable Use Agreement.
  • Acceptable Use Policy.
  • Abuse Handling Policy.
  • Privacy Policy.
  • Privacy / Data Protection Policy.
  • Information Security Policy.
  • Refund Policy.
  • Service Level Agreement.
  • Customer Service Policy.
  • Responsible Disclosure Policy.
  • Trademark & Copyright Policy.
  • Complaints & Dispute Resolution; and
  • other terms expressly applicable to the purchased Service.

Where a domain is registered or managed through Hostwover, the applicable domain agreements also apply separately.

3. Definitions

For this Agreement:

Professional Email

A business email Service allowing eligible Customers to create and use email addresses associated with a domain name.

Email Account

An individual mailbox or email identity provisioned through the Professional Email Service.

Mailbox

The storage and email environment associated with an Email Account.

Administrator

A Customer-authorized person permitted to create, configure, suspend, delete, or otherwise manage Email Accounts.

End User

An individual authorized by the Customer to use an Email Account.

Customer Data

Email messages, attachments, contacts, configuration, account information, and other data stored or processed through the Professional Email Service.

Domain

The domain name associated with the Professional Email Service.

Storage Allocation

The amount of mailbox or account storage provided under the applicable Professional Email Plan.

Add-On Storage

Additional storage purchased or allocated beyond the storage included with the applicable Professional Email Plan.

4. Nature of the Service

Hostwover Professional Email allows Customers to create business email addresses using an eligible domain.

Depending on the applicable plan, functionality may include:

  • individual mailboxes.
  • webmail.
  • SMTP.
  • IMAP.
  • POP where supported.
  • mobile and desktop email-client compatibility.
  • aliases.
  • forwarding.
  • contacts.
  • calendars where included.
  • spam filtering.
  • malware filtering.
  • mailbox administration.
  • storage management.
  • additional storage.
  • domain-level configuration.
  • email authentication functionality.
  • support; and
  • other email-related features.

Only features expressly included in the purchased plan are contractually included.

5. Professional Email Is a Separate Service

Professional Email is separate from:

  • Web Hosting.
  • domain registration.
  • VPS.
  • VDS.
  • Google Workspace; and
  • other Hostwover Services

unless expressly bundled.

Purchasing one Service does not automatically purchase, renew, or cancel another.

6. Service Plans

Hostwover may offer different Professional Email plans.

A plan may differ according to:

  • mailbox quantity.
  • storage.
  • features.
  • billing period.
  • administrative functionality.
  • add-on availability.
  • support functionality; and
  • other disclosed characteristics.

7. Plan Specifications

The specifications displayed for the purchased Professional Email Plan form part of the applicable Service description.

Hostwover may change plans offered for future purchases without automatically changing the Customer's current paid-term specifications.

8. Mailbox Quantity

The Customer may create Email Accounts only up to the quantity permitted by the applicable subscription.

Creating additional mailboxes may require:

  • increasing the mailbox quantity.
  • upgrading the plan.
  • purchasing additional licenses; or
  • another supported modification.

9. Per-Mailbox Storage

Each Email Account may receive a storage allocation determined by the applicable plan, mailbox quantity, configuration, or Service description.

Customers should review the storage allocation displayed for their subscription.

10. Storage Allocation Changes

Where Hostwover's Professional Email offering uses different storage allocations according to mailbox quantity or selected plan, changing the subscription may change the storage allocation applicable to individual mailboxes.

Hostwover will seek to make the applicable allocation clear before the Customer confirms a material plan change.

11. Add-On Storage

Hostwover may allow Customers to purchase additional mailbox storage.

Where Add-On Storage is available, it may be:

  • purchased in defined units.
  • assigned to selected mailboxes.
  • reallocated between eligible mailboxes.
  • returned to an available storage pool after removal from a mailbox; or
  • otherwise managed

according to the applicable Service functionality.

12. Add-On Storage Pool

Where the Service provides pooled Add-On Storage, unused purchased storage may remain available for assignment to eligible mailboxes.

The Account interface or applicable Service documentation will determine the current:

  • purchased amount.
  • assigned amount.
  • used amount; and
  • available balance.

13. Storage Add-Ons Are Not Separate Mailboxes

Purchasing additional storage does not by itself create additional Email Accounts.

Mailbox quantity and storage allocation are separate Service characteristics.

14. Storage Capacity

Customers are responsible for monitoring mailbox storage usage.

When a Mailbox reaches or approaches its limit:

  • receipt of new messages may fail.
  • sending may be affected.
  • synchronization may be affected.
  • mailbox functionality may be restricted; or
  • additional storage or cleanup may be required.

15. Customer Responsibility for Full Mailboxes

The Customer and End Users are responsible for managing data within their Storage Allocation.

Hostwover is not responsible for delivery failures caused solely by a Customer-controlled Mailbox remaining full after applicable storage information has been made available.

Mandatory legal rights remain unaffected.

16. Service Provisioning

After a valid Professional Email order is submitted, Hostwover will attempt to provision the Service.

Provisioning may require:

  • successful payment.
  • Account verification.
  • domain information.
  • domain ownership or control.
  • mailbox quantity.
  • administrator information.
  • technical configuration; and
  • other information reasonably required to activate the Service.

17. Provisioning Completion

The Service is considered active when provisioning has successfully completed and the relevant email-administration functionality becomes available.

An:

  • order.
  • invoice.
  • payment authorization.
  • pending status; or
  • provisioning request

does not by itself mean that provisioning is complete.

18. Provisioning Failure

Provisioning may fail because of:

  • invalid domain information.
  • payment failure.
  • verification failure.
  • unsupported configuration.
  • technical error.
  • Service availability.
  • domain status.
  • security concerns; or
  • another legitimate operational reason.

19. Paid Provisioning Failure

Where a paid Professional Email Service cannot be provisioned, the affected transaction will be handled according to:

  • Terms of Service.
  • Refund Policy; and
  • applicable law.

20. Domain Requirement

Professional Email generally requires a valid domain name.

The Customer is responsible for maintaining rights to use the Domain associated with the Service.

21. Domain Ownership

Using a Domain for Professional Email does not itself determine legal ownership of that Domain.

Domain ownership or registration rights are governed separately by the applicable domain-registration records and agreements.

22. Domain Expiration

If the Domain associated with Professional Email expires, email functionality may stop even if the Professional Email subscription itself remains active.

This may affect:

  • receiving mail.
  • sending mail.
  • authentication.
  • DNS resolution.
  • mailbox access through configured clients; or
  • other functionality.

23. Professional Email Does Not Renew the Domain

Renewing Professional Email does not automatically renew the associated Domain unless the Customer separately renews the Domain or the applicable order expressly combines the transactions.

24. Domain Transfer

Transferring the associated Domain does not automatically transfer, cancel, or migrate Professional Email.

The Customer must preserve the email-related DNS configuration where continued use of the Service is intended.

25. DNS Configuration

Professional Email may require DNS records including:

  • MX.
  • SPF.
  • DKIM.
  • DMARC.
  • TXT.
  • CNAME; or
  • other verification or mail-routing records.

26. Customer-Controlled DNS

Where DNS is controlled by the Customer or another provider, the Customer is responsible for applying the required records correctly.

27. Incorrect DNS

Incorrect DNS configuration may cause:

  • incoming mail failure.
  • outgoing mail authentication problems.
  • spam classification.
  • verification failure.
  • DKIM failure.
  • SPF failure.
  • DMARC failure; or
  • complete email interruption.

28. DNS Propagation

DNS changes may require time to propagate through distributed DNS caches.

Hostwover does not guarantee immediate recognition of every DNS change by all Internet systems.

29. MX Records

MX records determine where mail for the Domain is delivered.

Customers must ensure that applicable MX records point to the correct email environment.

30. SPF

Hostwover may provide recommended SPF configuration.

SPF helps receiving systems evaluate whether a server is authorized to send email for the Domain.

Incorrect SPF configuration may affect delivery.

31. DKIM

DKIM functionality may be provided or supported.

The Customer may need to publish applicable DNS records to enable DKIM authentication.

32. DMARC

Customers may configure DMARC according to their requirements.

An incorrectly configured restrictive DMARC policy may cause legitimate messages to be rejected or quarantined.

33. Email Authentication Is Shared Responsibility

Hostwover may provide the technical values or functionality required for supported email-authentication mechanisms.

Where the Customer controls DNS, the Customer is responsible for publishing and maintaining the required DNS records.

34. Email Account Creation

Administrators may create eligible Email Accounts through the available management interface.

Each Email Account must use a supported address under the applicable Domain.

35. Mailbox Names

The Customer is responsible for choosing lawful and appropriate mailbox names.

Examples may include:

  • name@domain.
  • support@domain.
  • sales@domain; or
  • other Customer-selected addresses.

36. Prohibited Impersonation

Customers must not create or use Email Accounts for unlawful or deceptive impersonation.

37. Administrator Authority

The Customer is responsible for ensuring that persons granted administrative privileges are authorized to manage the Professional Email subscription.

38. Administrator Capabilities

An Administrator may be able to:

  • create users.
  • reset passwords.
  • delete mailboxes.
  • change storage allocations.
  • configure aliases.
  • change forwarding.
  • suspend accounts.
  • modify settings; or
  • perform other supported administrative actions.

39. Customer Responsibility for Administrator Actions

The Customer is responsible for authorized Administrator actions.

Hostwover is not responsible for Customer Data changes caused solely by an authorized Administrator acting within permissions granted by the Customer.

40. End Users

Customers may assign Email Accounts to employees, contractors, representatives, or other authorized End Users.

The Customer remains responsible for ensuring that End Users comply with this Agreement and applicable Hostwover policies.

41. User Offboarding

When an End User no longer requires access, the Customer should promptly:

  • disable access.
  • reset credentials.
  • remove forwarding.
  • review aliases.
  • preserve necessary business data.
  • delete or reassign the Mailbox where appropriate; and
  • revoke access from devices.

42. Mailbox Reassignment

Where supported, the Customer may reassign an Email Account to another authorized user.

The Customer is responsible for handling existing Customer Data lawfully before reassignment.

43. Former Employee Mailboxes

Customers are responsible for determining lawful handling of email belonging to former employees or other departing users.

Hostwover does not determine employment-law or privacy rights between the Customer and its personnel.

44. Account Credentials

End Users and Administrators are responsible for protecting email credentials.

45. Password Security

Customers should require:

  • strong passwords.
  • unique passwords.
  • secure credential storage.
  • appropriate password changes; and
  • avoidance of credential sharing.

46. Multi-Factor Authentication

Where MFA is supported, Hostwover recommends enabling it for eligible administrative or mailbox access.

47. Credential Sharing

Credentials should not be shared with unauthorized persons.

Shared credentials make accountability and security more difficult.

48. Compromised Credentials

If the Customer suspects that an Email Account has been compromised, the Customer should promptly:

  • change the password.
  • revoke active sessions where supported.
  • review forwarding rules.
  • review filters.
  • review sent mail.
  • review aliases.
  • check recovery information.
  • inspect affected devices; and
  • notify Hostwover where assistance is required.

49. Hostwover Security Actions

Where Hostwover reasonably detects suspected account compromise, Hostwover may:

  • require password reset.
  • terminate sessions.
  • restrict sending.
  • suspend the Mailbox.
  • require verification.
  • disable suspicious forwarding.
  • restrict administrative changes; or
  • take another proportionate protective action.

50. Mailbox Content

The Customer retains applicable rights in Customer Data stored through Professional Email.

Hostwover does not obtain ownership of Customer email messages merely because they are processed through the Service.

51. Limited Processing Authorization

The Customer authorizes Hostwover to technically process email data where reasonably necessary to:

  • deliver messages.
  • receive messages.
  • store mail.
  • synchronize mailboxes.
  • filter spam.
  • detect malware.
  • provide requested support.
  • maintain security.
  • maintain the Service.
  • investigate abuse.
  • comply with law; or
  • fulfill Hostwover's contractual obligations.

52. Customer Responsibility for Message Content

The Customer is responsible for email messages and attachments sent by its End Users.

53. Lawful Email Use

Professional Email must be used in accordance with:

  • applicable law.
  • Terms of Service.
  • Acceptable Use Policy.
  • Abuse Handling Policy; and
  • other applicable requirements.

54. Spam Prohibited

Professional Email must not be used to send unsolicited bulk email prohibited by applicable law or Hostwover policies.

55. Examples of Prohibited Email Activity

Prohibited activity may include:

  • spam campaigns.
  • phishing.
  • credential theft.
  • malware delivery.
  • email bombing.
  • fraudulent messages.
  • deceptive sender impersonation.
  • forged identities.
  • scam campaigns.
  • malicious attachments; or
  • other prohibited communications.

56. Bulk Email

Professional Email should not be assumed to be a mass-marketing or high-volume bulk-mail platform unless Hostwover expressly offers that capability.

57. Marketing Email

Customers sending marketing email are responsible for complying with applicable:

  • consent requirements.
  • unsubscribe requirements.
  • sender-identification requirements.
  • marketing laws.
  • privacy laws; and
  • recipient preferences.

58. Mailing Lists

Use of mailing lists must remain within the technical and policy limits of the Professional Email Service.

Large-scale campaigns may require a specialized email-delivery Service.

59. Sending Limits

Professional Email may apply limits relating to:

  • messages per minute.
  • messages per hour.
  • messages per day.
  • recipient count.
  • concurrent connections.
  • message size.
  • attachment size; or
  • other anti-abuse and technical thresholds.

The applicable limits depend on the Service configuration.

60. Sending Limits May Protect the Service

Sending limits may be used to:

  • prevent spam.
  • reduce compromised-account abuse.
  • protect mail reputation.
  • protect system stability.
  • reduce fraud; and
  • support fair use.

61. No Right to Circumvent Sending Limits

Customers must not attempt to circumvent applicable sending limits through:

  • multiple mailboxes.
  • automation designed to evade restrictions.
  • forged identities.
  • unauthorized relays; or
  • another method intended to bypass anti-abuse controls.

62. Temporary Sending Restrictions

Hostwover may temporarily restrict outgoing mail where unusual activity indicates:

  • compromise.
  • spam.
  • malware.
  • abuse.
  • excessive sending.
  • unusual authentication.
  • or another material risk.

63. Rate Limiting

Mail traffic may be rate-limited where reasonably necessary to maintain:

  • deliverability.
  • platform stability.
  • reputation; or
  • security.

64. Email Delivery

Hostwover seeks to transmit legitimate email reliably but does not guarantee delivery of every message.

65. Delivery Factors Outside Hostwover's Control

Email delivery may be affected by:

  • recipient server policies.
  • recipient spam filters.
  • blocklists.
  • DNS.
  • SPF.
  • DKIM.
  • DMARC.
  • sender reputation.
  • message Content.
  • attachments.
  • recipient mailbox capacity.
  • recipient configuration.
  • Internet routing.
  • recipient-provider outages; or
  • other third-party systems.

66. Delivery Does Not Mean Inbox Placement

Successful transmission of a message does not guarantee placement in the recipient's primary inbox.

A recipient may place a message in:

  • spam.
  • junk.
  • quarantine.
  • promotions.
  • another folder; or
  • another filtering category.

67. Bounce Messages

A message may generate a delivery failure or bounce notification.

The Customer is responsible for reviewing recurring delivery failures.

68. Invalid Recipients

Repeatedly sending messages to large numbers of invalid or nonexistent recipients may trigger anti-abuse controls.

69. Complaint Rates

High spam-complaint rates may result in:

  • rate limits.
  • investigation.
  • temporary suspension.
  • sending restriction; or
  • other proportionate action.

70. Sender Reputation

Sender reputation may depend on factors beyond Hostwover's direct control.

These may include:

  • sending behavior.
  • recipient engagement.
  • spam complaints.
  • bounce rates.
  • domain reputation.
  • authentication.
  • message Content; and
  • third-party reputation systems.

71. No Reputation Guarantee

Hostwover does not guarantee a specific sender or domain reputation score.

72. Third-Party Blocklists

Independent organizations may maintain email blocklists.

Hostwover does not control every third-party blocklist.

73. Blocklist Assistance

Where appropriate, Hostwover may investigate or assist with a deliverability or reputation issue.

Hostwover cannot guarantee removal from an independent blocklist.

74. Incoming Mail

Hostwover seeks to receive messages directed to valid active Email Accounts, subject to applicable:

  • filtering.
  • security.
  • storage.
  • message-size.
  • domain.
  • DNS; and
  • account restrictions.

75. Spam Filtering

The Professional Email Service may use automated spam filtering.

Spam filters can produce:

  • false positives.
  • false negatives.
  • quarantined messages; or
  • rejected messages.

No spam filter can identify every unwanted message perfectly.

76. Customer Spam Review

Where a spam or quarantine interface is available, Customers should review it when expecting important messages that have not appeared in the inbox.

77. Malware Filtering

Professional Email may include mechanisms intended to detect or restrict malicious:

  • attachments.
  • links.
  • executable files.
  • scripts; or
  • other harmful Content.

78. No Malware Detection Guarantee

No malware-detection system can guarantee identification of every malicious file or link.

End Users should continue to exercise caution with unexpected attachments and links.

79. Attachment Restrictions

Certain file types or attachments may be:

  • blocked.
  • quarantined.
  • limited.
  • rejected; or
  • modified

for security or technical reasons.

80. Message Size Limits

Professional Email may impose a maximum message size.

Message size may include:

  • message body.
  • headers.
  • attachments.
  • encoding overhead; and
  • related data.

81. Large File Transfer

Professional Email should not be assumed to be a general-purpose large-file-transfer system.

Customers needing to transfer very large files should use an appropriate storage or file-sharing Service.

82. Webmail

Where Webmail is included, Customers may access eligible Email Accounts through a browser-based interface.

83. Webmail Compatibility

Webmail is designed for supported current browsers.

Substantially outdated or unsupported browsers may experience reduced functionality.

84. IMAP

Where IMAP is available, End Users may synchronize email with compatible clients.

85. POP

Where POP access is supported, local client configuration may affect whether messages remain on the server.

Customers are responsible for understanding their client settings.

86. SMTP

SMTP access may be provided for sending mail according to applicable authentication and anti-abuse requirements.

87. Email Client Configuration

The Customer is responsible for correctly configuring third-party email clients.

Hostwover may provide supported configuration information but does not control third-party client software.

88. Third-Party Email Clients

Hostwover does not guarantee that every:

  • mail client.
  • operating system.
  • mobile application.
  • plugin; or
  • legacy protocol implementation

will remain compatible with Professional Email.

89. Client Software Updates

Customers should keep email client software reasonably current for security and compatibility.

90. Local Mail Copies

Where an email application downloads local copies of messages, Hostwover does not control those local copies.

The Customer is responsible for security and backup of locally stored data.

91. Forwarding

Professional Email may provide email-forwarding functionality.

92. Forwarding Risks

Forwarded mail may be affected by:

  • spam filtering.
  • authentication alignment.
  • recipient-provider policies.
  • forwarding loops.
  • reputation.
  • or other technical considerations.

93. Forwarding Loops

Customers must not intentionally create forwarding configurations that cause mail loops or material Service disruption.

94. External Forwarding

Hostwover does not control delivery after a message is forwarded to an external email provider.

95. Aliases

Eligible plans may allow Email Aliases.

An alias may receive email for delivery to another Mailbox but does not necessarily provide an independent Mailbox or independent storage.

96. Catch-All Email

Catch-all functionality, where available, may increase unwanted mail and should be configured carefully.

Availability is not guaranteed for every plan.

97. Auto-Responders

Where supported, auto-responder functionality must not be configured in a way that creates mail loops, spam, or abuse.

98. Filters and Rules

End Users may be able to create:

  • message filters.
  • forwarding rules.
  • folders.
  • auto-replies; or
  • other mailbox automation.

The Customer is responsible for Customer-created rules.

99. Compromised Forwarding Rules

Account compromise may result in malicious forwarding or filtering rules.

Customers investigating compromise should review such rules carefully.

100. Contacts and Calendars

Where contacts, calendars, or related collaboration features are included, their availability and storage characteristics depend on the applicable plan.

101. Contacts

Customers are responsible for Personal Data stored in their contact lists.

102. Calendar Invitations

Hostwover does not control whether external recipients accept, reject, filter, or correctly process calendar invitations.

103. Customer Data Privacy

Hostwover processes Professional Email-related Personal Data according to its Privacy Policy and applicable data-protection requirements.

104. Customer as Controller

Where the Customer determines why and how Personal Data in its Email Accounts is processed, the Customer may act as a controller or equivalent responsible party under applicable data-protection law.

105. Hostwover as Processor

Where Hostwover processes email Personal Data solely to provide the Professional Email Service on the Customer's behalf, Hostwover may act as a processor or equivalent service provider.

Additional data-processing terms may apply where required.

106. End-User Privacy Notices

The Customer is responsible for providing any privacy notices required for the Customer's own End Users, employees, customers, or correspondents.

107. Lawful Monitoring by Customers

If the Customer monitors or accesses employee or End-User mailboxes, the Customer is responsible for determining whether such monitoring is lawful and appropriately disclosed.

108. Hostwover Does Not Determine Employment Rights

Hostwover does not determine whether a Customer is legally entitled to inspect an employee's email.

The Customer must obtain its own legal guidance where required.

109. Confidentiality

Hostwover seeks to protect Customer Data using technical and organizational measures appropriate to the Service.

110. Security Measures

Security controls may include:

  • authentication.
  • access controls.
  • encryption in transit where technically applicable.
  • spam controls.
  • malware controls.
  • monitoring.
  • logging.
  • anti-abuse controls.
  • administrative restrictions; and
  • other appropriate safeguards.

111. No Absolute Security Guarantee

No email system can be guaranteed completely secure against every:

  • phishing attempt.
  • malware attack.
  • credential compromise.
  • zero-day vulnerability.
  • social-engineering attack.
  • misconfiguration; or
  • third-party threat.

112. Shared Security Responsibility

Hostwover is responsible for security measures within Hostwover's control.

The Customer is responsible for matters including:

  • End-User passwords.
  • administrator access.
  • Customer devices.
  • mailbox permissions.
  • forwarding configuration.
  • Customer DNS.
  • user security awareness; and
  • Customer-controlled integrations.

113. Customer Device Security

End Users should protect devices used to access Professional Email.

Compromised Customer devices may expose:

  • passwords.
  • messages.
  • attachments.
  • contacts.
  • tokens.
  • sessions; or
  • other Customer Data.

114. Public Computers

Customers should exercise caution when accessing Professional Email from public or shared computers.

115. Saved Passwords

Customers are responsible for password storage performed by their own:

  • browsers.
  • operating systems.
  • password managers.
  • email clients; or
  • devices.

116. Account Recovery

Hostwover may provide recovery procedures for eligible administrative or Email Accounts.

Recovery may require identity or ownership verification.

117. Recovery Verification

Hostwover may request additional verification where a recovery request presents elevated security risk.

118. No Bypass of Security Controls

Customers must not attempt to bypass:

  • authentication.
  • sending limits.
  • anti-spam systems.
  • account restrictions.
  • security verification.
  • administrative permissions; or
  • other technical controls.

119. Email Retention

Messages remain stored subject to:

  • available Storage Allocation.
  • Customer deletion.
  • mailbox configuration.
  • retention settings where available.
  • suspension.
  • termination.
  • applicable backup lifecycle; and
  • legal obligations.

120. Customer-Deleted Messages

When an End User deletes a message, the message may move through one or more states such as:

  • Deleted Items.
  • Trash.
  • recoverable deletion.
  • permanent deletion; or
  • backup retention

depending on the Service.

121. No Guaranteed Recovery of Deleted Email

Hostwover does not guarantee recovery of every deleted email.

Customers should not rely on recoverability after permanent deletion.

122. Mailbox Deletion

Deleting a Mailbox may result in deletion of:

  • messages.
  • folders.
  • contacts.
  • mailbox settings.
  • rules.
  • aliases associated exclusively with that Mailbox; and
  • other Mailbox data.

123. Confirm Before Deleting Mailboxes

Administrators should preserve necessary Customer Data before deleting an Email Account.

124. Deleted Mailbox Recovery

Where deleted-mailbox recovery is technically available, it may be:

  • time limited.
  • subject to backup availability.
  • subject to verification.
  • subject to fees; or
  • unavailable.

Hostwover does not guarantee deleted-mailbox recovery unless expressly stated.

125. Recreating an Address

Creating a new Mailbox with the same email address after deletion does not guarantee restoration of the previous Mailbox data.

126. Backups

Professional Email may use backup or recovery systems as part of Service operation.

A Customer-facing backup or restore feature is included only where expressly stated.

127. Backup Is Not Archival Service

Unless expressly offered, Professional Email should not be treated as an indefinite legal archive or records-management Service.

128. Customer Archiving Requirements

Customers subject to legal, regulatory, contractual, or business archiving obligations are responsible for implementing appropriate archiving arrangements.

129. Independent Copies

Customers with critical email-retention requirements should maintain appropriate independent copies or archiving systems.

130. Backup Limitations

No backup system can guarantee recovery from every:

  • accidental deletion.
  • corruption.
  • malicious deletion.
  • account compromise.
  • software issue.
  • infrastructure failure; or
  • other event.

131. Legal Preservation

Hostwover may preserve certain records where legally required.

Legal preservation does not necessarily make those records available to the Customer.

132. Data Export

Where functionality is available, Customers may export or synchronize mailbox data before cancellation or migration.

133. Migration Into Professional Email

Hostwover may offer mailbox migration assistance.

Migration may depend on:

  • source provider.
  • supported protocols.
  • source credentials.
  • mailbox size.
  • source restrictions.
  • source availability.
  • data format; and
  • technical compatibility.

134. Migration Authorization

By requesting migration, the Customer represents that the Customer is authorized to access and migrate the source mailboxes.

135. Migration Credentials

Temporary source credentials may be required.

Customers should provide migration credentials only using an appropriate authorized method.

136. Rotate Migration Credentials

Where appropriate, Customers should change temporary or exposed source credentials following completion of the migration.

137. Migration Scope

A migration may include supported:

  • email messages.
  • folders.
  • mailbox structure; or
  • other expressly supported data.

It may not necessarily include:

  • every contact.
  • every calendar.
  • every rule.
  • every signature.
  • every alias.
  • every forwarding rule.
  • every local-only message; or
  • unsupported proprietary data.

138. Migration Completeness

Hostwover cannot guarantee that every mailbox from every external platform can be migrated perfectly.

139. Source Provider Limitations

Migration may be affected by restrictions imposed by the source email environment.

140. Migration Testing

Customers should verify migrated mailboxes before terminating the previous email Service.

141. DNS Cutover

Moving mail delivery to Professional Email may require changing MX and related DNS records.

The Customer should coordinate DNS changes carefully to reduce the risk of missed messages.

142. Propagation During Migration

During DNS propagation, some senders may temporarily deliver messages according to older cached DNS information.

143. Source Mailbox Retention

Customers should avoid deleting source mailboxes immediately after migration until they have verified successful data transfer and mail flow.

144. Migration Out of Hostwover

Customers may migrate their email to another provider subject to their right to access the relevant Customer Data and applicable Service status.

145. Export Before Termination

Customers should complete required export or migration before terminating Professional Email.

146. Hostwover Does Not Guarantee Migration After Deletion

Once Mailboxes or the subscription have been permanently deleted, Hostwover may be unable to provide migration data.

147. Availability

Hostwover seeks to provide reliable Professional Email Services.

No email Service can be guaranteed to operate without interruption unless an applicable Service Level Agreement expressly provides a specific commitment.

148. Service Level Agreement

Where an SLA applies, it governs:

  • availability commitments.
  • measurement.
  • exclusions.
  • Service credits.
  • claim procedures; and
  • applicable remedies.

149. No Implied SLA

Marketing statements do not create an availability guarantee separate from the applicable SLA.

150. Maintenance

Professional Email may require:

  • scheduled maintenance.
  • software updates.
  • infrastructure maintenance.
  • security updates.
  • storage maintenance.
  • network maintenance; or
  • emergency work.

151. Scheduled Maintenance

Where reasonably practical, Hostwover may provide advance notice of scheduled maintenance expected to materially affect availability.

152. Emergency Maintenance

Emergency maintenance may occur without advance notice where necessary to address:

  • security vulnerabilities.
  • infrastructure failure.
  • storage problems.
  • active attacks.
  • mail-delivery risk.
  • data-integrity concerns; or
  • another urgent technical issue.

153. Third-Party Infrastructure

Hostwover may rely on authorized third-party technology, infrastructure, software, networks, or data centers to deliver portions of Professional Email.

Hostwover remains responsible for its own obligations under the applicable agreement and law.

154. Underlying Technology Changes

The technical platform used to provide Professional Email may change where reasonably necessary for:

  • security.
  • functionality.
  • reliability.
  • provider changes.
  • licensing.
  • technical modernization; or
  • Service continuity.

155. Customer-Facing Brand

Changes to underlying technical arrangements do not automatically change the Customer's contractual relationship with Hostwover.

156. Service Migration by Hostwover

Hostwover may migrate Professional Email accounts between supported infrastructure where reasonably necessary.

157. Migration Protection

Where Hostwover performs an infrastructure migration, Hostwover will seek to preserve Customer Data and minimize unnecessary interruption.

158. Migration Effects

Technical migration may cause temporary:

  • synchronization delays.
  • mail-routing changes.
  • DNS requirements.
  • authentication changes.
  • client reconfiguration; or
  • short interruptions.

159. Client Reconfiguration

Customers may need to update email-client settings following certain material technical changes.

Hostwover will seek to provide relevant configuration information where Customer action is required.

160. Service Changes

Hostwover may make reasonable changes to Professional Email to:

  • improve security.
  • improve reliability.
  • improve functionality.
  • replace obsolete technology.
  • maintain compatibility.
  • comply with law; or
  • protect the Service.

161. Core Paid Features

Hostwover will seek not to materially reduce the core specifications of a paid Professional Email Plan during its current paid term without an appropriate:

  • reason.
  • replacement.
  • migration.
  • remedy.
  • Customer option; or
  • treatment required by applicable law.

162. Feature Changes

A specific feature may change or be discontinued where:

  • technology becomes obsolete.
  • security requires removal.
  • licensing changes.
  • compatibility ends.
  • law requires a change; or
  • a replacement is introduced.

163. Discontinued Plans

Hostwover may discontinue Professional Email Plans for new purchases.

Existing subscriptions may be:

  • maintained.
  • migrated.
  • replaced.
  • upgraded.
  • provided another option; or
  • otherwise handled according to applicable law and Service requirements.

164. Billing

The billing provisions in Hostwover's Terms of Service apply.

165. Billing Period

Professional Email may be offered using:

  • monthly.
  • yearly; or
  • another disclosed billing period.

166. Mailbox-Based Pricing

Pricing may depend on factors including:

  • number of mailboxes.
  • storage tier.
  • billing period.
  • Add-On Storage.
  • plan.
  • currency.
  • promotion; and
  • applicable taxes.

167. Increasing Mailbox Quantity

Adding mailboxes may increase the subscription price.

Where the Service adjusts storage tiers based on mailbox quantity, the applicable storage allocation may also change.

168. Reducing Mailbox Quantity

Before reducing the number of subscribed mailboxes, the Customer may need to:

  • delete mailboxes.
  • preserve data.
  • remove users.
  • resolve allocated Add-On Storage; or
  • otherwise bring usage within the lower subscription quantity.

169. No Automatic Data Preservation on Reduction

Reducing mailbox quantity does not automatically guarantee preservation of mailboxes selected for deletion.

Customers must export important data first.

170. Add-On Storage Billing

Additional storage may be billed separately from the base Professional Email subscription.

171. Storage Removal

Where supported, removing assigned Add-On Storage from a Mailbox may return unused eligible capacity to the Customer's available storage pool rather than cancelling the underlying purchased storage.

The management interface will determine the applicable status.

172. Cancelling Add-On Storage

Cancelling purchased Add-On Storage may require the Customer to first reduce total Mailbox usage to fit within the remaining available allocation.

173. No Forced Data Truncation Without Appropriate Process

Hostwover will not intentionally delete Customer Data merely because the Customer requests a storage downgrade without applying the relevant Service process.

The Customer may be required to reduce usage before the downgrade can complete.

174. Renewal

Professional Email subscriptions may renew for recurring billing periods.

175. Auto-Renew

Where Auto-Renew is enabled, Hostwover may attempt to charge an authorized payment method for renewal.

176. Auto-Renew Is Not Guaranteed

Automatic renewal may fail because of:

  • declined payment.
  • insufficient funds.
  • expired payment method.
  • removed authorization.
  • Account restrictions.
  • verification.
  • technical problems; or
  • other payment-processing issues.

177. Renewal Price

Renewal pricing may differ from:

  • introductory pricing.
  • promotional pricing.
  • initial purchase price.
  • or previous renewal pricing.

178. Price Changes

Future Professional Email pricing may change because of:

  • infrastructure costs.
  • licensing costs.
  • storage costs.
  • currency movements.
  • taxes.
  • Service changes; or
  • commercial pricing decisions.

179. Renewal Notices

Hostwover may send operational reminders concerning:

  • upcoming renewal.
  • failed renewal.
  • payment problems.
  • subscription expiration; or
  • Service termination.

180. Failed Renewal

If renewal fails, the Service may:

  • enter an unpaid state.
  • be restricted.
  • be suspended.
  • expire; or
  • eventually terminate.

181. Suspension for Non-Payment

Hostwover may suspend Professional Email for unresolved non-payment where contractually and legally permitted.

182. Effect of Non-Payment Suspension

Suspension may affect:

  • sending.
  • receiving.
  • Webmail.
  • synchronization.
  • administration.
  • mailbox access; and
  • related functionality.

183. Suspension Does Not Automatically Cancel Billing

Where resources remain allocated during suspension, charges may continue according to the applicable subscription.

184. Security Suspension

Hostwover may suspend an Email Account or Professional Email subscription where reasonably necessary because of:

  • compromise.
  • phishing.
  • spam.
  • malware.
  • fraud.
  • credential theft.
  • security risk.
  • prohibited activity; or
  • another serious violation.

185. Account-Level Suspension

Where reasonably possible, Hostwover may restrict only the affected Email Account instead of the entire Customer subscription.

186. Domain-Level Suspension

Widespread abuse across multiple mailboxes may justify broader restrictions where necessary to protect the Service.

187. Immediate Action

Hostwover may take immediate action without prior notice where delay would create material:

  • security harm.
  • fraud.
  • spam.
  • phishing risk.
  • infrastructure harm.
  • reputation harm; or
  • third-party harm.

188. Abuse Investigation

Hostwover may investigate credible reports involving Professional Email.

189. Investigation Information

An investigation may involve relevant:

  • sending logs.
  • authentication events.
  • source IP information.
  • message metadata.
  • complaint information.
  • mailbox identifiers.
  • security alerts.
  • timestamps; and
  • other information reasonably necessary to investigate the issue.

190. Message Content During Investigations

Hostwover will not routinely inspect message Content merely because the Customer uses Professional Email.

Content may be processed or accessed where reasonably necessary and legally permitted for purposes such as:

  • requested technical support.
  • security investigation.
  • malware analysis.
  • abuse investigation.
  • legal compliance; or
  • another authorized purpose.

Customers must reasonably cooperate with legitimate:

  • security investigations.

  • Account recovery.
  • ownership disputes; and

Required remediation may include:

  • password changes.
  • removing compromised devices.
  • disabling an Email Account.
  • removing malicious forwarding.
  • stopping bulk sending.
  • reviewing user access.
  • enabling security controls; or
  • another proportionate action.

193. Repeated Abuse

Repeated unresolved abuse may result in:

  • sending restrictions.
  • Mailbox suspension.
  • subscription suspension.
  • termination; or
  • another action permitted by applicable policies.

194. Account Ownership Disputes

Where multiple parties claim control of Professional Email, Hostwover may require evidence such as:

  • identity information.
  • Domain ownership evidence.
  • company records.
  • Account history.
  • invoices.
  • authorization documents; or
  • other relevant information.

195. Business Email Ownership

Where Professional Email is purchased by an organization, the organization may have administrative rights over Email Accounts created for its workforce, subject to applicable law and contractual arrangements.

196. Hostwover Does Not Decide Employment Disputes

Hostwover is not a court and does not determine employment or corporate ownership disputes where a binding legal determination is required.

197. Temporary Restrictions During Ownership Disputes

Hostwover may temporarily restrict sensitive administrative actions while a credible ownership dispute is being evaluated.

198. Legal Requests

Hostwover may respond to valid legal requests relating to Professional Email where required by applicable law.

199. Legal Actions

Where legally required, Hostwover may:

  • preserve information.
  • disclose information.
  • restrict an Account.
  • suspend access; or
  • take another legally mandated action.

200. No Voluntary Disclosure Merely on Request

Hostwover will not treat a person's unsupported claim to be an authority as sufficient legal basis for disclosure of Customer Data.

201. Cancellation by the Customer

Customers may cancel eligible Professional Email Services using available Account functionality or another supported cancellation method.

202. Cancellation Effect

Depending on the selected cancellation option, cancellation may:

  • disable future renewal; or
  • terminate the subscription

according to the applicable Service process.

203. Cancellation Does Not Cancel Domain

Cancelling Professional Email does not automatically:

  • cancel the Domain.
  • delete the Domain registration.
  • cancel Web Hosting.
  • cancel VPS.
  • cancel VDS.
  • cancel Google Workspace; or
  • cancel another independent Service.

204. Export Before Cancellation

Customers must preserve important mailbox data before Service termination.

205. Service Expiration

If Professional Email is not successfully renewed, the Service may expire.

206. Effects of Expiration

Following expiration:

  • sending may stop.
  • receiving may stop.
  • Webmail may become inaccessible.
  • synchronization may stop.
  • administration may be restricted.
  • mailboxes may become unavailable; and
  • Customer Data may eventually be deleted.

207. Temporary Retention

Hostwover may temporarily retain expired Professional Email data according to the applicable technical lifecycle.

Temporary retention should not be treated as a guaranteed recovery period unless expressly stated.

208. No Guaranteed Post-Expiration Retention Period

Hostwover does not guarantee that expired Mailboxes will remain recoverable for a particular number of days unless the applicable Service description expressly provides such a period.

209. Customer Recovery Request

Where expired mailbox recovery remains available, Hostwover may require:

  • payment.
  • Account verification.
  • Domain verification.
  • identity verification; or
  • another appropriate requirement.

210. No Recovery Guarantee

Hostwover cannot guarantee recovery of Customer Data after expiration, deletion, or termination.

211. Termination by Hostwover

Hostwover may terminate Professional Email where permitted by applicable law and justified by circumstances including:

  • material breach.
  • repeated abuse.
  • phishing.
  • fraud.
  • serious spam.
  • malware.
  • persistent non-payment.
  • legal requirement.
  • severe security risk; or
  • another basis permitted under the Terms of Service.

212. Notice Before Termination

Where reasonably possible and appropriate, Hostwover may provide notice or an opportunity to remediate an issue before termination.

Immediate termination or suspension may occur where delay creates a serious risk.

213. Effect of Termination

After termination:

  • Email Accounts may stop working.
  • administrative access may stop.
  • mail routing may fail.
  • stored Customer Data may become inaccessible.
  • mailbox identifiers may be released; and
  • Customer Data may eventually be permanently deleted.

214. Data Deletion

After the applicable technical and legal retention period, Hostwover may permanently delete Customer Data associated with the terminated Service.

215. Residual Backups

Deleted information may temporarily remain in backup systems until the normal backup lifecycle expires.

216. Backups Do Not Extend Service Rights

Residual backup copies do not create a right to restore an expired or terminated subscription indefinitely.

217. Mailbox Address Reuse

After termination or deletion, Hostwover does not guarantee continued reservation of a particular Mailbox address if the associated Domain or Service configuration later changes.

218. Refunds

Professional Email refund eligibility is governed by:

  • Refund Policy.
  • applicable Service conditions; and
  • mandatory law.

219. Refund Factors

Refund treatment may depend on:

  • Service activation.
  • billing term.
  • number of Mailboxes.
  • Add-On Storage.
  • usage.
  • promotional conditions.
  • previous refunds.
  • termination reason; and
  • timing.

220. Completed Billing Periods

Amounts relating to Services already validly consumed may be non-refundable where permitted by applicable law and the Refund Policy.

221. Add-On Refunds

Add-On Storage refund eligibility may differ from the base subscription depending on whether it has been activated or consumed.

222. Upgrade

Hostwover may allow Customers to:

  • add mailboxes.
  • increase storage.
  • select a higher plan.
  • add functionality; or
  • otherwise upgrade the subscription.

223. Upgrade Pricing

Applicable pricing will be displayed before confirmation.

224. Upgrade Effects

An upgrade may change:

  • mailbox quantity.
  • per-mailbox storage.
  • available Add-On Storage.
  • features.
  • subscription price; or
  • other Service characteristics.

225. Downgrade

A Professional Email downgrade may be available where Customer usage fits within the lower configuration.

226. Downgrade Requirements

Before downgrading, the Customer may need to:

  • delete mailboxes.
  • reduce stored data.
  • reallocate storage.
  • remove Add-On Storage.
  • remove features; or
  • otherwise satisfy the lower plan's limits.

227. Customer Data Before Downgrade

Customers should export important data before deleting Mailboxes or reducing storage as part of a downgrade.

228. No Automatic Destructive Downgrade

Where Customer usage exceeds a lower plan's supported limits, Hostwover may prevent the downgrade until the Customer reduces usage rather than automatically deleting Customer Data.

229. Support

Hostwover provides Professional Email support within the supported scope of the Service.

230. Support May Include

  • improve reliability.
  • introduce features.

  • industry standard; or
  • security certification.

257. Customer Records Management
